Terms of Service

Draft template, not legal advice. This document was written to be a solid starting point for a two-sided delivery marketplace, but it hasn't been reviewed by a lawyer. Have one review it — especially the independent-contractor, liability, and background-check sections — before relying on it with real users.

1. What Serious Load is

Serious Load ("we," "us," "the platform") operates a marketplace connecting people and businesses who need something delivered ("Shippers") with independent drivers who provide delivery services ("Drivers"). Serious Load is not a delivery company, a common carrier, or a freight broker — we provide the technology that lets Shippers and Drivers find and transact with each other.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use Serious Load. You're responsible for the accuracy of the information on your account and for all activity that happens under it. Driver accounts additionally require a valid driver's license, and a CDL for any vehicle class that legally requires one.

3. The Serious Load fee

Serious Load charges a flat platform fee, currently 10%, on every completed delivery. The fee is disclosed to both the Shipper and the Driver before a job is booked or accepted — it is never added on top of the quoted price without being shown first.

4. Drivers are independent contractors

Drivers using Serious Load are independent contractors, not employees, agents, or partners of Serious Load. Drivers set their own schedule, choose which jobs to accept or bid on, and are responsible for their own vehicle, fuel, insurance, and applicable taxes. Nothing in these Terms creates an employment relationship.

5. Background checks

Where enabled, Drivers must complete a background check through our screening provider before accepting jobs. By requesting a check, you authorize the provider to collect and report information relevant to that check, subject to their own privacy practices and your consent through their platform. Serious Load receives only the check's clear/consider status — we do not receive or store the underlying report details, your Social Security number, or date of birth.

6. Payments and payouts

Payments are processed by Stripe. Shippers are charged the full job price when a delivery is completed; Drivers are paid their share (the job price minus the platform fee) via a connected payout account. Serious Load does not store your full card or bank account numbers — that data is held by Stripe.

7. Cancellations

Either party may cancel a delivery before it is picked up. Once a Driver has picked up the item, cancellation may still be requested but is handled case by case, since the Driver has already committed time and mileage to the job.

8. Ratings and conduct

Shippers and Drivers rate each other after every completed delivery. Ratings are intended to reflect real experiences — manipulating ratings, harassment, discrimination, or unsafe driving are all grounds for suspension or removal from the platform.

9. Prohibited items and conduct

You may not use Serious Load to transport anything illegal to possess, transport, or sell, or anything that violates applicable law or the safety of a Driver or the public. We may remove any listing or account that violates this.

10. Limitation of liability

Serious Load provides the platform "as is." To the maximum extent permitted by law, we are not liable for the acts, omissions, or negligence of any Shipper or Driver, for the condition or handling of goods in transit, or for indirect, incidental, or consequential damages arising from use of the platform.

11. Changes to these terms

We may update these Terms from time to time. Continued use of Serious Load after a change takes effect means you accept the updated Terms.
